. federal law signed into law by president clinton in 1996. it says if a person is legally married in a state, the federal government can't recognize those marriages. that's where you talked about federal benefits heterosexual couples get and same sex couples do not. the prop 8 thing is bigger. while potentially it's confined to the state of california only, the question it out there having given the right to gay marriage could the state then take it away through proposition 8 passed by a majority of the vote nurse 2008. having taken that case, the court could get to the bedrock issue. can any state refuse to let same sex couples get married under the federal constitution. it could potentially be narrow or very far. >> pete, as i understand it, let me ask you. this one of these things, maybe the driving one, is defense of marriage act was about paying the estate act. where one of the two people said she didn't have to pay the estate tax because a married couple wouldn't have to. >> reporter: this is a case from new york. a woman named edie windsor who married her partner in canada.

a court of law where you can go in and say this is the evidence. irrefutable proof. but on the other hand, there are certain things that the intelligence community can do. for example, they can assess how stockpiles are accumulating in the country. you mentioned that the russians had supplied some of these chemical agents and that is true. you can assess how each of these areas, you know what they've done, how they've done it and how often. also, you can have some intelligence that specifically outlines exactly how good the chemical weapons are. whether they will be used, what kind of training these people have and all this is weighed in. >> there are reports that the assad regime has loaded on to missiles, that they are ready to go. to your point, you need to get between assad and the person who's going to push the button. how do we know that? that they've loaded them on to missiles? >> there have been reports this week from the "new york times" about preparations and from nbc. now, do we know that's accurate? we don't. they're trying to assess exactly where are they in the decision cycl

this afternoon. the hope was he would dial back on some of his decrees and that put himself above the law. three important points. number one, he said he decree applies only to sovereign matters of state, whatever that means. as far as we can tell it doesn't mean much of anything. the second thing, his decree to shield his decisions from any legal action didn't aim to stop judicial work. in other words he wished the judges across the country hadn't walked out. but they did. he tried to make himself a dictator. so he has that problem. and maybe most importantly here is the latest word, he said he will not tolerate anyone working to overthrow a legitimate government. it is all about semantics here. you could certainly say they were working to overthrow the legitimate government. he forgot to mention the government was put in-law git matily has now changed -- legitimately has now changed. and if that stands there is clearly going to be trouble. egypt is at a turning point as mohamed morsi is speaking. anymore news of note i will bring it to you. >>> the white house vows if -- there will be conseque
